James Dunlap Will

I, James Dunlap of the county and state a foresaid being of sound mind, but weak and infirm of body and knowing that it is allotted, to all to die, do make this my last Will and Testament.

 

Article 1st. I commit and command my soul to God who gate it and pray that he will accept it as righteous through the righteousness of the Lord and savior Jesus Christ, and my body I will to the silent grave in plain but decent burial the expenses whereof to be paid out of my worldly estate.

 

Article 2nd. It is my will and desire that all my just debts be paid out of my estate.

 

Article 3. I give and bequeath to my beloved wife Mary Dunlap, a Negro woman by the name of Hannah, all my stock of cattle and their increase and my horse for her sole and separate use for and during the term of her natural life and after the death of my said wife, Mary, the said Negro woman Hannah, stock of cattle and the horse to be sold to the highest bidder.

 

Article 4th. I give and bequeath to my said wife Mary all the household and kitchen furniture.

 

Article 5th. All my other worldly estate consisting of a number of promissory notes amounting in the aggregate to six thousand seven hundred and one dollars, thirty three cents, more or less. I will and desire that my Executor proceed to the collection of all sums under one hundred dollars and all other demands which they may deem in _____or in danger to be lost and to put the same out on interest with bond and good security. Also I will and desire that my executors annually collect all the interest due on all notes and to appropriate the whole or any part thereof, and any part of the principal to furnish a decent and comfortable support for my beloved wife Mary for and during the term of her natural life, and it is my express will and desire that after the support of my said wife is taken out of my own worldly estate, that the remainder both principal and interest be from year to year continually kept at interest during her life.

 

Article 6th. I give and bequeath to my two sons Joseph Dunlap and Robert Dunlap the sum of five dollars each to be paid out of any money of mine that may come to the hands of my Executors.

 

Article 7th. After the death of my wife Mary Dunlap it is my will and desire that all the money belonging to my estates, with its increase from interest be equally divided between my seven children William Dunlap, John Dunlap, Samuel Dunlap, James R. Dunlap, Salley Roden, wife of James Roden, Mary S. Clinton wife of Matthew Clinton, Eliza C. Bunnell, wife of J. Canfield Bunnell.

 

Article 8th. I constitute and appoint John Dunlap, Samuel Dunlap and James R. Dunlap the Executors of this my last will and testament. In witness whereof I have herein taken my hand and affixed my seal on the 28th day of October 1834.
